Terms and Conditions:
Apex Nepal Treks and Tours is recognized for its professionalism, expertise, and commitment to delivering exceptional adventure travel experiences in the Himalayan region. To ensure the well-being of our customers and to avoid any confusion or misunderstandings please read the following terms and conditions. These terms and conditions govern the contractual relationship between Apex Nepal Treks and Tours, and the participants booking Trekking Tours with us.
Booking Confirmation and Payment:
Ø All bookings are considered confirmed only after receipt of a deposit or full payment. Failure to comply with the payment terms may result in cancellation of the booking.
Ø Prices are subject to change without prior notice until the booking is confirmed. The company is under no obligation to furnish a breakdown of the costs involved in the itinerary of the trip.
Ø We accept payment via various methods, including credit/debit cards, bank transfers, and online payment platforms. Any applicable transaction fees will be borne by the client.
Cancellation and Refund Policy:
Ø Cancellation of booking must be notified to us by letter or email by the participant or party leader as soon as possible. The following cancellation charge will be applicable:
Ø 2months or more: 20% of the total fee would be charged if the traveler wishes to cancel his/her trip.
Ø 30days to 60days: 40% of the total fee would be charged if the participant wishes to cancel his/her trip.
Ø 10days to 30days: 70% of the total fee would be charged if the participant wishes to cancel his/her trip.
Ø Within 7days from the trip departure date: 100% fee would be charged (NO-REFUND in any case whatsoever)
Ø If the trip is cancelled in the middle of journey due to unforeseen incidents eg. Bad weather, natural disaster or personal accidents then no-refund policy would be applied. Similarly, if the traveler wishes to terminate his plan of completing the trip due to his/her personal reasons or health issues then no amount would be refunded whatsoever.
Travel Insurance:
Ø It is strongly recommended that all participants purchase comprehensive travel insurance that includes coverage for trip cancellation, medical emergencies, evacuation, and personal belongings.
Ø The company is not liable for any loss, damage, injury, or inconvenience sustained by participants during the trip.
Ø The traveler/ trekker shall bear any additional and personal costs if otherwise mentioned in the Including Items
Health and Fitness Requirements:
Ø Trekking tours involve physical activity and may require a certain level of fitness. Participants are responsible for assessing their own physical fitness and ensuring that they are adequately prepared for the trekking-Tour adventure. Participants are responsible for termination of the trip due to their fitness and health issues, hence no-refund policy applies on it.
Ø Any pre-existing medical conditions or physical limitations must be disclosed to the company prior to booking. So that company would be aware of it, and it would help us to be prepared or take swift actions if required. Any costs arisen during the trip due to health & fitness issues shall bear the participant himself/ herself.
Itinerary Changes:
The company reserves the right to modify or adjust the itinerary, accommodation, transportation, or activities due to unforeseen circumstances, including but not limited to weather conditions, natural disasters, political unrest, changes in local regulations, or some technical issues occurred to the transportation or accommodation. Any extra cost occurred due to itinerary change, accommodation change, or transportation change shall be borne by the traveler.
Travel Documents:
Ø Participants are responsible for ensuring that they possess valid passports, visas, permits, and any other required documents for the trip.
Ø The company will not be held liable for any consequences resulting from incomplete or invalid documents.
Code of Conduct:
Ø Participants are expected to always conduct themselves in a respectful and responsible manner, respecting local customs, traditions, and the environment. We encourage the principle of “Leave no traces except Footprints and take only Memories”.
Ø The company reserves the right to refuse providing service or terminate participation in the trip without refund if a participant’s behavior is deemed to be disruptive, unsafe, or in violation of local laws.
Limitation of Liability:
Ø The company shall not be liable for any loss, damage, injury, delay, or inconvenience arising from the acts of Nature, force Majeure, or any other event beyond it’s control. In no event shall the company be liable for any indirect, incidental, special, or consequential damages.
Governing Law and Jurisdiction:
Ø These terms and conditions shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising from or related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Nepal.
Our Liability to you:
Ø We make sure that the trip arrangements we have agreed to make, perform or provide as applicable as part of our contract with you are made, performed or provided with reasonable skill and care.
Ø Apex Nepal Treks & Tours shall provide the services as stated in the itinerary.
Miscellaneous:
Ø The company reserves the right to use any photographs or videos taken by company members during the tour for promotional purposes unless otherwise specified by the participants in advance.
Ø Special Meal Request or Diets: We request you to notify us in advance if you have any allergy with any food items or diets. Also request you to remind the field member from time to time to avoid serving allergic food items. Participants are responsible for any food/ diet allergy or any other health issues that occurred due to food intake.
By booking a Tour, Trekking, and Climbing Expeditions with APEX NEPAL TREKS & TOURS, participants acknowledge that they have read, understood, and agreed to abide by these terms and conditions.
